Abstract

One of the aspects of compensation is its spiritual type. This importance has been taken into consideration in the legal system of most countries and it has been formalized in our country by the Civil Liability Law approved in 1339.On the other hand, even taking into account the occupational immunities in the office of a judge, mistakes may occur on the part of judges as human beings (errors are allowed) in the courts and in the proceedings, and material or moral damage may be caused to individuals that cannot be compensated. It is against justice and fairness. This research has been done by analytical-descriptive method and tries to investigate the compensation of this type of damage caused by the mistakes of judges, from two aspects of the Iranian and French models. The result of the research is that in our country, the theory of civil liability has been recognized, which also applies to moral damages. If this damage is caused by the mistake of the judge, the damage can be considered from various aspects, including material and spiritual, but the procedures for dealing with it are somewhat unclear and have challenges.
